As is often the case I am juggling a few deals right now. It’s the end of the year and in my world that either means things are super busy or super slow.
This year it’s pretty busy.
And looking at the deals my desk right now I can see a few of them have really different feels.
Some deals are moving along nicely and everyone’s getting along.
In others there’s more contention.
So it makes me wonder, what is the difference? Why do some deals go smoother than others?
And looking at it the difference between the deals is really a lot of “fluff.” The “soft stuff.”
While I have my part of the pie too as a deal lawyer I am usually not in the lead of how everyone feels. That’s on the business folks that I am helping or negotiating with.
But in the really good deals the business leaders are thinking about feel. They care about the other side. They want to communicate well and do the right thing.
In the deals where things are rougher around the edges I don’t see as much care.
I mean we all have to deal with jerks. Some times it can’t be avoided.
But odds are if you are investing in “energy” and how everyone in the deal feels you’ll do better.
